Terms of sale

General conditions applicable from 01/01/2023 cancel and replace the previous ones if applicable.

Object

These conditions of sale are intended to define the contractual relations between the lessor and the lessee. These conditions of sale shall prevail over any other general or special conditions not expressly approved by the lessor. The lessor reserves the right to modify its general conditions at any time without notice: the applicable conditions will be those in force on the date of the order by the lessee.

Legal Regime:

The rental is granted at the price, charges and special conditions indicated on the seasonal rental contract.

Prior to the conclusion of the seasonal rental contract, the client will find on https://www.villa-valbonne.fr all the necessary information about the price, the acts and the elements of the stay and in particular the situation of the accommodation, the typology, the capacities, etc.

Pre-booking:

If a customer wishes to put an option on a particular period, he must make a pre-booking, which must mention the identity of the tenants, the number of people, the dates of entry and exit desired and the presence of pets

A pre-booking has a validity of 8 calendar days from its date of dispatch (4 days in July and August). After this period, the accommodation concerned will be considered as available.

Booking:

Any reservation becomes definitive after the payment of a deposit of 30% of the total rental price by the tenant and signature of the rental contract.

Upon receipt of these elements, the commitments of the parties are then final and the final contract is returned countersigned to the tenant.

Settlement of the balance:

The full rental price will be required:

One month before the start of your stay for any booking made more than 1 month before the start of your stay,

Or immediately for any reservation made less than 1 month before the start of the stay.

Security Deposit:

A security deposit will be requested upon arrival of the tenant. The security deposit may in no case be considered as a partial payment of the rent.

The deposit will be returned as much as possible on the day of the tenant’s departure, nevertheless and especially in the case of payment by transfer the restitution will be made within a maximum period of 15 days from the tenant’s departure, and after deduction of the compensation withheld for any damage caused, unpaid benefits and/or loss of keys.

Entry into the premises:

The contract takes effect on the day of arrival from 4pm and ceases automatically on the day of departure at 10am. The key collection will take place on site, after checking that the balance of the rental and the security deposit are paid by the tenant.

If the tenant cannot arrive on the first day of the rental, he must inform the lessor before the day of arrival indicated in the rental agreement, in order to avoid that the reserved accommodation is rented again.

The tenant undertakes to take the rented premises in the state in which he will find it at the time of the entry into use as described in the rental contract.

The inventory of the apartment is considered compliant. All installations and appliances are considered in working order. Any complaint and/or anomaly concerning the accommodation must be reported no later than 48 hours after the entry of the premises. Failing this, the premises and equipment are deemed to be in good condition.

Insurance and Risk:

The lessor shall not be liable in the event of loss, theft, or damage to personal effects belonging to the lessee.

The tenant will be held responsible and not covered by the insurance of the house for any damage, degradation that would occur as a result. In this case, the repair costs are entirely at his own expense. He can purchase specific insurance if he wishes.

To prevent the risk of drowning, the pool is equipped with two standard safety devices, an alarm and a cover, which the tenant must use.

Tenant Obligations:

The tenant must absolutely refrain from throwing into the sinks, bathtubs, sinks, toilets, etc. objects that are liable to obstruct the pipes, failing which he will be liable for the costs incurred for the return to service of these appliances.

The tenant must ensure that the tranquility of the neighborhood is not disturbed by its fact. He has an obligation on the spot to occupy the premises personally, to inhabit them “as a good family man”, and to maintain them. A cleaning of the premises is provided at the end of the stay nevertheless if the level of dirt is too consequent a detention will be carried out on the deposit.

Under penalty of termination, the lessee may not, under any circumstances, sublet or assign his rights to this agreement. The premises currently rented must not under any circumstances be occupied by more persons than indicated in the rental agreement.

Departure arrangements:

The tenant is required to vacate his accommodation no later than 10am on the day of his departure, he must inform no later than 24h in advance the schedule of his departure.

Contract Cancellation:

In case of cancellation by the tenant within 30 days of arrival or if the tenant does not take possession of the accommodation on the day of its rental without having previously notified the lessor, the entire rent (deposit and balance) will be kept by the lessor.

In case of cancellation by the tenant more than 30 days before the scheduled date, only the amount of the deposit will be permanently lost.

In the case of cancellation by the tenant more than 60 days before the scheduled date, the full amount of the rental will be refunded less any bank fees.

If it turns out, at the delivery of keys, that the tenant does not respect the information mentioned on the rental agreement (identity of the tenant, number of people, presence of pets) the lessor may cancel it without notice and without restitution of the sums collected.

Assignment of Competencies:

For the performance of these terms, the undersigned parties elect domicile in the domicile of the lessor and agree that in case of dispute, the competent court will be exclusively that of the jurisdiction of the situation of the rented accommodation.
